Judicial Activism

In the United States the people at the state level have voted on the homosexual marriage issue 37 times.  It has failed every single time, even in liberal states like California.  Despite this overwhelming evidence that the people don't want gay marriages to be legal, several state legislatures and many judges have decided that it will be legal.

In colonial times sodomy was a crime that received the death penalty.  In the early history of the United States it was illegal in every state and even carried life imprisonment.  It is absurd to believe that the founding fathers ever had any desire to permit homosexuals to marry each other.  In fact, homosexual behavior was illegal in every state until just recently; the courts made it legal.

The people don't want homosexuals to be able to marry each other and they don't want homosexual acts to be legal.  Yet out of control, activist, leftist judges have legalized both of these practices. The Congress and state legislatures have been too timid to write new laws to replace those struck down by the courts.  The courts have gotten too powerful and too activist; that's the view from the Hysterical Right Wing.
